Central Administrative Tribunal

The Central Administrative Tribunal, New Delhi has been asked by the Delhi High Court to "undertake course correction" with reference to how it handles first applications. "The orders should not reflect a careless attitude by the Tribunal but rather the due application of mind by the Tribunal to the problems raised before it," the tribunal stated in its order.

According to the petitioner, the Tribunal failed to consider the grievance in connection to each assessment year independently and did not even address the other arguments he made.

The respondents further acknowledged that the Tribunal did not address the petitioner's complaint in connection to each of the evaluation years separately. However, it was asserted that the Tribunal's conclusions were sound.

The Court said after hearing from the parties that once an applicant approaches the Tribunal, he has the right expectation that he would be heard and that the matter will be resolved on the basis of merits. The Tribunal's orders ought to reflect the same, it continued.
